Abstract

Does Nordic legal co-operation have a future within the European Union?Nordic co-operation in the form of legally binding agreements has been a longstanding tradition. After the accession of Finland and Sweden to the European Union, the circumstances have changed. The EU’s exclusive competence limits the extent to which its Member States may conclude or maintain agreements with non-EU states or with each Nordic states’ ability to maintain or develop harmonized rules that differ from EU law diminishes over time. This article explores the different ways Nordic and EU co-operation have been reconciled in the Nordic agreements and in EU legislation. In areas that are heavily regulated by the EU, the continuation of Nordic co-operation in practice entails substantive alignment with EU law. Nevertheless, when Nordic co-operation has provided added value, it has been possible to maintain this through a variety of techniques. Moreover, there are fields where the competence to legislate in the EU is narrow, which still leaves room for deeper Nordic co-operation.
