Abstract

Tujuan penelitian ini adalah untuk menganalisis tentang judi online: problematika dan implikasinya dalam hukum ekonomi syariah. Jenis penelitian ini adalah kepustakaan (Library research) dengan pendekatan yang digunakan adalah teologi normatif dan sosiologi ekonomi. Teknik pengumpulan data yakni data primer dan data sekunder. Hasil penelitian ini disimpulkan bahwa dalam hukum ekonomi syariah, larangan terhadap perjudian sebagai bagian dari jarimah ta'zir. Jarimah ta'zir merupakan pidana yang sanksinya tidak secara tegas ditentukan dalam al-Quran maupun Hadis, melainkan kepada pemerintah/hakim untuk menetapkannya. Problematika dan implikasi Perjuring online dapat mengakibatkan kemerosotan moral/nilai dalam masyarakat, seperti nilai material, nilai vital serta terhadap nilai agama. Judi Online memiliki dampak yang buruk terhadapat masyarakat muslim termasuk merusak prinsip-prinsip Maqashid Syariah, seperti dampak terhadap hifzh al-din, hifzh al-nafs, hifzh al-‘aql, hifzh al-mal, hifzh al-nasl.
