The article, "La «obra» protegida por el Derecho de Autor," addresses a foundational and perpetually debated question within intellectual property law: the precise scope and definition of what constitutes a "work" eligible for copyright protection. The abstract clearly articulates the central problem, noting that despite copyright's general coverage of original literary and artistic creations, the current legal framework suffers from significant ambiguities. Specifically, it points to a critical lack of clarity regarding the interpretation of "originality," the criteria for identifying protectable artistic or literary creations, and the contentious exclusion of ideas from legal safeguarding, even when these form the very essence or integral value of a creative manifestation. The strength of this work lies in its explicit identification of these critical gaps, which are essential for the consistent and equitable application of copyright law. By spotlighting the vagueness surrounding the definition of originality and the criteria for protectable creations, the author establishes a clear and timely research agenda. The abstract further indicates a robust methodological approach, proposing to analyze contributions from both legal doctrine and established jurisprudence. This dual perspective is particularly commendable, as it promises to integrate theoretical insights with practical judicial interpretation, thereby offering a comprehensive and nuanced understanding of the complexities inherent in the subject matter. The stated objective "aportar soluciones a las carencias que la protección actual de la obra suscita" is both ambitious and highly relevant to contemporary copyright discourse. If successful, this study has the potential to significantly inform legal practitioners, policymakers, and academics by offering a more precise and actionable framework for understanding and applying copyright principles. The commitment to addressing the unprotected status of ideas, whether as the genesis of creation or integral content, suggests a critical and forward-thinking perspective that could contribute meaningfully to the ongoing evolution of intellectual property rights, particularly in Spanish-speaking legal systems.
