Ketidakpatuhan dewan perwakilan rakyat terhadap putusan mahkamah konstitusi (studi putusan nomor 91/puu-xviii/2020 tentang undang-undang cipta kerja). Kaji ketidakpatuhan DPR terhadap Putusan MK No. 91/PUU-XVIII/2020 mengenai UU Cipta Kerja. Temukan analisis hukum normatif dan dampaknya pada kepastian hukum serta legitimasi DPR di Indonesia.

Abstract

Tujuan penelitian ini adalah untuk mengkaji ketidakpatuhan Dewan Perwakilan Rakyat terhadap Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII 2020 tentang Undang-Undang Cipta Kerja. mengenai kepastian hukum didalamnya terkait pelaksanaan Putusan Mahkamah Konstitusi. Jenis penelitian adalah penelitian hukum normatif. Adapun pendekatan yang digunakan dalam penelitian ini, yaitu 1). Pendekatan Perundang-undangan (Statute Approach), 2). Pendekatan Konseptual (Conceptual Approach). Sumber bahan hukum yang diperoleh dari kepustakaan (research document) Jenis bahan hukum adalah hukum primer, sekunder dan tersier. Analisis bahan hukum menggunakan penelitian normatif, sehingga peneliti akan melakukan suatu penafsiran-penafsiran dan kajian-kajian untuk menelaah bahan hukum yang diperoleh untuk menghasilkan uraian sistematis dan terstruktur, serta menjawab rumusan masalah. Adapun hasil penelitian antara lain 1). Ketidakpatuhan Dewan Perwakilan Rakyat (DPR) terhadap Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 didasarkan pada kelemahan dalam mekanisme pengawasan serta kecenderungan politik legislasi yang mengutamakan kepentingan tertentu. DPR tidak sepenuhnya menjalankan perintah Mahkamah Konstitusi untuk memperbaiki prosedur pembentukan Undang-Undang Cipta Kerja sesuai prinsip partisipasi publik yang bermakna. 2). Akibat dari ketidakpatuhan ini, secara hukum, Undang-Undang Cipta Kerja tetap berlaku tetapi berpotensi digugat kembali, menciptakan ketidakpastian hukum bagi investor dan masyarakat. Selain itu, legitimasi DPR dalam proses legislasi semakin dipertanyakan, yang dapat melemahkan kepercayaan publik terhadap sistem hukum dan demokrasi di Indonesia.

The findings offer a compelling diagnostic of challenges within the Indonesian legislative landscape, particularly concerning the balance of power and the sanctity of judicial review. While the abstract sufficiently details the problem and its consequences, the implicit call for greater institutional accountability and procedural integrity resonates strongly. This work is highly recommended for its timely analysis and its potential to stimulate further scholarly and policy discussions on strengthening democratic governance and adherence to constitutional mandates in Indonesia.
